Rules for using Memoriam
These terms govern access to Memoriam's public site, memorial-creation tools, organization portal, published tribute pages, and memorial purchasing flows. They are intended to reflect the product that is currently available in the app.
Acceptance and eligibility
By using Memoriam, creating an account, uploading content, or completing a purchase, you agree to these Terms of Service. If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
You may only use Memoriam in compliance with applicable law and for memorial, remembrance, or closely related professional purposes supported by the product.
Accounts and account security
You are responsible for keeping your sign-in credentials secure and for the activity that occurs under your account. You must provide accurate information for account creation, billing, and organization membership management.
Memoriam may suspend access, require re-authentication, or take other protective action if we believe an account has been compromised, is being misused, or violates these terms.
Your content and permissions
You retain ownership of the text, photos, videos, and branding assets you upload to Memoriam. However, you grant Memoriam a limited license to host, store, process, display, transmit, and render that content as needed to operate the service.
You are responsible for making sure you have the rights and permissions needed to upload memorial content, publish tribute pages, share personal stories, and use any organization branding assets added to the service.
Public memorial publishing
Memoriam supports private draft creation and public memorial publishing. When you publish a memorial, that memorial can be displayed on public routes that do not require login, including Memoriam-hosted tribute URLs and organization-branded public routes where applicable.
You are responsible for deciding what information, images, videos, or personal details are appropriate to publish publicly. Once a memorial is public, others may access it through the shared link.
Payments, subscriptions, and billing
Memoriam currently offers one-time memorial publishing purchases and recurring professional subscriptions. Checkout and billing are processed through Stripe.
Prices, taxes, and billing cadence are presented at checkout. Professional subscriptions continue until canceled through the available billing flow or otherwise terminated. Unless required by law or expressly stated at checkout, purchases are not automatically refundable.
Access to paid features may depend on successful payment, current subscription status, and payment reconciliation across Stripe and Memoriam.
Acceptable use
You may not use Memoriam to:
- upload unlawful, infringing, malicious, or deceptive content
- impersonate another person or falsely claim rights to memorial materials
- interfere with platform security, rate limits, or normal operation
- attempt to access another user's account, private media, or billing information
Service availability and changes
Memoriam may update, modify, or discontinue features as the product evolves. We do not guarantee uninterrupted availability, perfect performance, or that every memorial, export, or public page will remain continuously accessible without maintenance or operational interruptions.
Features described as planned or future-facing elsewhere in the product materials are not part of these terms unless they are actually shipped in the app.
Suspension and termination
Memoriam may suspend or terminate access to accounts, organizations, or published content that violate these terms, create security risk, fail required payments, or expose the service or other users to harm.
You may stop using the service at any time. Deleting memorials or organization content may remove public access to that material, subject to the service's operational deletion and retention processes.
Disclaimers and limits
To the fullest extent permitted by law, Memoriam is provided on an "as is" and "as available" basis. We do not promise that the service will always be uninterrupted, error-free, or suitable for every purpose.
To the fullest extent permitted by law, Memoriam is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service, your published content, or third-party services involved in authentication, storage, payments, email delivery, or hosting.
Changes to these terms
Memoriam may revise these terms as the product or legal requirements change. Updated terms will be posted on this page with a revised effective date.
